Baby Stone Studios – Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you" or "User") and HNRQ FAITTA LTDA., a Brazilian limited liability company operating under the trade name Baby Stone Studios ("Baby Stone Studios," "we," "our" or "us"). These Terms govern your access to and use of our mobile games, websites, applications, software, virtual items, and related services (collectively, the "Services").

By downloading, installing, accessing or using any part of the Services, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

  1. Eligibility
    You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account or use the Services. If you are under the age of majority in your jurisdiction, your parent or legal guardian must also review and accept these Terms and supervise your use of the Services.

  2. Account Registration & Security
    You may need to create an account to access certain features. You agree to:
    Provide accurate, current and complete information;
    Maintain the confidentiality of your login credentials;
    Notify us immediately of any unauthorized use of your account; and
    Be responsible for all activities that occur under your account.

You must not share, lend, sell, or otherwise provide access to your account or login credentials to any third party. Your account is personal and non-transferable. You are solely responsible for all activity on your account, and we shall not be liable for any loss or damage — including but not limited to loss of virtual currency, items, progress, or unauthorized purchases — arising from your decision to share account access with others.

We reserve the right to reclaim usernames or suspend/terminate accounts that violate these Terms.

  1. License Grant & Restrictions
    Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install and use the Services for your personal, non-commercial entertainment. You may not:
    Copy, modify, reverse engineer, decompile or disassemble any part of the Services;
    Create derivative works, cheats, bots, hacks, automation tools, or unauthorized modifications;
    Sell, rent, lease, sublicense, share, lend, or otherwise transfer the Services, your account, account credentials, virtual currency, or virtual items except as expressly permitted by us; or
    Use the Services for any illegal, abusive, fraudulent, or unauthorized purpose.

  2. Ownership & Intellectual Property
    All right, title and interest in the Services, including all software, artwork, music, text, characters, designs, logos, names, gameplay elements, virtual items, and other content, are and shall remain the exclusive property of HNRQ FAITTA LTDA., operating under the trade name Baby Stone Studios, or its licensors.

No rights are granted to you other than those expressly set forth herein.

  1. User-Generated Content (UGC)
    The Services may permit you to create, post, upload or share content ("UGC"). By submitting UGC, you:
    Grant Baby Stone Studios a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform and display your UGC in connection with the Services;
    Represent and warrant that you own or have the necessary rights to grant the above license; and
    Agree that we may remove, restrict, moderate, or modify any UGC at our sole discretion.

You are solely responsible for your UGC and for any consequences thereof. You agree not to submit content that is illegal, offensive, abusive, threatening, discriminatory, defamatory, sexually explicit, invasive of privacy, or otherwise harmful to other users or to the Services.

  1. Virtual Items & Purchases
    The Services may include virtual currency, virtual items, subscriptions, passes, licenses, boosts, cosmetics, rewards, or other digital content (collectively, "Virtual Items"). Virtual Items have no monetary value, are not redeemable for real money, and do not constitute personal property. All purchases of Virtual Items are final and non-refundable, except where required by applicable law or by the policies of the platform through which the purchase was made, such as Apple App Store, Google Play, or other authorized platforms.

Baby Stone Studios shall not be responsible for restoring, replacing, or compensating any Virtual Items, virtual currency, progress, or rewards lost as a result of account sharing, lending, unauthorized access, misuse of account credentials, violation of these Terms, or use of unauthorized third-party software. Requests for restoration of Virtual Items lost due to such actions may be denied.

We may, at our sole discretion and without prior notice, modify, substitute, replace, suspend, remove, rebalance, or discontinue any Virtual Item, feature, reward, or in-game economy element.

  1. Updates, Changes & Discontinuation
    We reserve the right, at any time and in our sole discretion, to update, modify, add to, remove, rebalance, suspend, or discontinue the Services, any feature of the Services, or any Virtual Item, without liability or prior notice. This may include, but is not limited to, balancing changes, new content, bug fixes, changes to rewards, removal of content, server migrations, technical adjustments, or changes to gameplay systems.

We are under no obligation to continue supporting any version of the Services or to provide any updates, patches, or specific content. Continued use of the Services after an update constitutes acceptance of the updated Services.

  1. Anti-Cheat & Fair Play
    You agree not to:
    Use cheats, hacks, automation software, bots, macros, mods, emulators used for abusive purposes, memory editors, unauthorized third-party software, or any other tool that modifies or interferes with the Services;
    Exploit bugs, glitches, errors, vulnerabilities, or unintended mechanics;
    Manipulate purchases, rewards, ads, subscriptions, server requests, game data, rankings, or progression systems;
    Use the Services to harass, threaten, spam, abuse, deceive, or disrupt other users; or
    Attempt to gain unauthorized access to our systems, servers, databases, or user accounts.

Violation of this section may result in immediate suspension or termination of your account, removal from rankings, loss of Virtual Items, loss of progress, or other corrective measures at our discretion.

  1. Third-Party Platforms & Services
    Your access to the Services through third-party platforms, including but not limited to Apple App Store, Google Play, payment providers, advertising networks, analytics providers, cloud services, or login services, may be subject to the terms and policies of those third parties.

Baby Stone Studios is not responsible for third-party platform policies, outages, technical issues, payment processing, refund decisions, fee structures, account restrictions, or service interruptions caused by those third parties.

Any refunds related to purchases made through Apple App Store, Google Play, or another third-party platform must be requested directly through the applicable platform and will be subject to that platform’s policies.

  1. Service Availability & Downtime
    We do not guarantee that the Services will be uninterrupted, secure, error-free, or available at all times. Maintenance, updates, server issues, internet connectivity problems, platform outages, data errors, or unforeseen technical issues may cause downtime, loss of data, delayed rewards, bugs, or temporary unavailability.

You acknowledge that your use of the Services is at your sole risk.

  1. Suspension & Termination
    We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we determine, in our sole discretion, that you have violated these Terms, abused the Services, engaged in fraudulent activity, harmed other users, violated fair play rules, or created legal, technical, or security risks.

Upon termination, all licenses granted to you shall immediately terminate, and you may lose access to your account, progress, Virtual Items, subscriptions, rewards, rankings, and any other content associated with the Services, except where otherwise required by applicable law or platform policies.

  1. Disclaimer of Warranties
    THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BABY STONE STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, RELIABILITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF BUGS, FREE OF DATA LOSS, OR THAT ANY DEFECTS WILL BE CORRECTED.

  1. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HNRQ FAITTA LTDA., BABY STONE STUDIOS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, MORAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, VIRTUAL ITEMS, ACCOUNT ACCESS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US THROUGH THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) US $100, OR ITS EQUIVALENT IN LOCAL CURRENCY.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

  1. Indemnification
    You agree to indemnify, defend and hold harmless HNRQ FAITTA LTDA., Baby Stone Studios, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:
    Your access to or use of the Services;
    Your UGC;
    Your violation of these Terms;
    Your violation of any applicable law or third-party right; or
    Your misuse of the Services, including cheating, fraud, unauthorized access, or abusive behavior.

  2. Governing Law & Jurisdiction
    These Terms shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Services shall be submitted to the competent courts of Brazil.

The parties elect the courts of the District of Chapecó, State of Santa Catarina, Brazil, as the venue to resolve any disputes arising from these Terms or the Services, except where applicable consumer protection laws require a different mandatory venue.

Nothing in this section limits either party’s right to seek urgent or equitable relief before a competent court to prevent actual or threatened infringement, misuse, fraud, security breaches, or violation of intellectual property rights.

  1. Changes to These Terms
    We may revise these Terms from time to time. We will post the updated Terms and indicate the “Last Updated” date. Your continued use of the Services after any change constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.

  2. Miscellaneous
    Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time.

Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and HNRQ FAITTA LTDA., operating under the trade name Baby Stone Studios, regarding the Services, and supersede any prior agreements or understandings.

No Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.
